Last Will and Testament - Fernando De Freitas
           
           

I Fernando De Freitas of the City of Saint John in the Island of Antigua, Shopkeeper, do hereby revoke all former will and testament, any dispositions made by me, and declare this to be my last will and testament.

I appoint Joseph De Freitas my nephew now in charge of my business in Corn Alley in Long Street, and Joseph Fernance Jardine of the town of Parham in the Island of Antigua to be the Executors and Trustees of this my will.

I direct that my funeral and testamentary expenses, and any debts that may be owing by me at the time of my death shall be paid by my executors out of the first monies forming part of my personal Estate that shall come to their hands.

I bequeath the following legacies, that is to say:

  • to Manuel De Freitas, son of my niece Jokina Fereira of the Island of Madeira the sum of one thousand dollars

  • to Ferdinand De Freitas, the son of my nephew Emanuel De Freitas of Antigua deceased, the sum of Two thousand dollars

  • to Victorina, the daughter of my nephew the daughter of Emanuel De Freitas of Antigua deceased and wife of George Ignatius Mendes, Barrister at Law, the sum of One thousand dollars

  • to the lawful children of Victorina, wife of George Ignatius Mendes aforesaid, the sum of One thousand dollars in equal shares

  • to Virginia, the daughter of my nephew Emanuel De Freitas of Antigua deceased and wife of Norris Mendes, the sum of One thousand four hundred dollars

  • to Lily De Freitas, daughter of my said nephew Emanuel De Freitas the sum of One thousand four hundred dollars

  • to Adelaide De Freitas, daughter of my nephew John De Freitas, late of the city of Saint John the sum of Eight hundred dollars

  • to Leonard De Freitas, son of my nephew John De Freitas aforesaid, the sum of Eight hundred dollars

  • to Lilian, the daughter of my niece Mary Gonsalves deceased and wife of Cyril Aloysius Gomes of the city of Saint John aforesaid, the sum of Fourteen hundred dollars

  • to Antonio De Freitas, the sum of Nine hundred dollars and to Joseph De Freitas, the sum of one thousand dollars, sons of my brother Antonio deceased of the Island of Madeira

  • to Umbelina, the wife of my nephew Antonio Gomes deceased of the Island of Antigua the sum of one thousand dollars

  • to Manuel Gomes, son of my said nephew Antonio Gomes deceased of the Island of Antigua the sum of Nine hundred dollars

  • to my Godson Lawrence Gomes, son of the late Manuel Gomes of the Island of Antigua the sum of Two hundred dollars

  • to John Anjo, of the aforesaid Island hair dresser the sum of Forty dollars

  • to my Godsons Clement De Silva, son of Emanuel De Silvia deceased the sum of Sixty dollars

  • to Clement Pereira, son of Antonio Pereira deceased the sum of Fifty dollars, and

  • to Emanuel Gomes, son of Joseph Gomes and Fanny Gomes nee De Freitas at present residing in Demerara the sum of Thirty dollars

  • to the lawful Children of Joseph Gomes, in the Island of Madeira the sum of Six hundred dollars in equal shares

  • to Augusta, the wife of my nephew Joseph De Freitas the sum of Six hundred dollars

  • to the lawful son of Augusta, wife of the said Joseph de Freitas the sum of Four hundred dollars

  • to Eva Jardine, of the Island of Antigua the sum of Two hundred and fifty dollars

I give and bequeath the good, the will and benefit of my liquor establishment which I am now carrying on in Long Street and Corn Alley, and also all my Capital and Stock in trade which shall be employed therein at my decease to my nephew Joseph De Freitas and Manuel Fereira of the Island of Antigua. Whether he shall prove my will or not. Subject Nevertheless to all debts that may be owed by the said business at the time of my decease, and in the event of any of the aforesaid legatees dying in my lifetime leaving lawful issue him, or her, or them surviving them. I direct that the legacy of the person so dying shall go to, and be received by the issue of such person in equal shares, and I declare that any person entitled to receive any legacy under this my will, who at the time of the actual payment thereof shall be a married woman, shall enjoy such legacy as her separate property, free from all marital Control and his sole receipt shall be a good discharge.

I give and bequeath to Mary De Freitas, wife of my nephew Emanuel De Freitas deceased, the sum of one hundred and fifty dollars and in the event of her dying in my lifetime then I direct that the said sum of one hundred and fifty dollars shall be paid to the Children of the said Mary De Freitas in equal shares.

I give to His Lordship, the Bishop of Roseau the sum of Three hundred dollars in aid of the Catholic Church in Antigua.

  • to the Priest in charge of the Catholic Mission in Antigua at the time of my death the sum of one hundred dollars for Masses for the repose of my Soul and I declare, that all the legacies given by this my will shall be paid out of the moneys of which I shall die possessed, and that in the event of my dying not possessed of sufficient money to pay all such legacies in full then each of such legacies shall be rateably reduced

I authorize my trustees in their discretion to carry on my business in the City of Saint John aforesaid, not hereby otherwise disposed of, and in such case I direct my trustees to pay the net profits arising therefrom to my nieces Victorina wife of George Ignatius Mendes, Virginia wife of Norris Mendes, Lily De Freitas, and my nephew Ferdenand De freitas, Lily daughter of my niece Mary Gonsalves deceased, Leonard De Freitas and Adelaide De Freitas son and daughter of my nephew John De Freitas deceased, Umbelina wife of my nephew Antonio Gomes deceased aforesaid, and Marcel Gomes son of my nephew Antonio Gomes deceased in equal shares.

I devise my freehold house and land wherein I now reside at the Corner of Long Street and Corn Alley, in the City of Saint John to my niece Victorina wife of George Ignatius Mendes aforesaid.

I give and bequeath all my plate, linen, china, glass, books, pictures, furniture and household effects wherein I now reside at the Corner of Long Street and Corn Alley in the City of Saint John to my nephew Manuel Fereira aforesaid.

I devise my freehold house and land in Long Street in the City of Saint John, situate immediately to the East of my residence to Adelaide De Freitas daughter of my nephew John de Freitas late of the City of Saint John aforesaid deceased.

I devise my freehold house and land in High Street and Corn Alley in the City aforesaid to Leonard De Freitas son of my nephew John De Freitas aforesaid.

I devise my freehold house and land situate in Long Street and Church Alley in the City aforesaid to my nephew Ferdenand De Freitas aforesaid.

I devise my freehold house and land number Thirty Six High Street in the City aforesaid which I purchased from Miss Fox, together with a piece of land measuring from East to West twelve feet, and from North to South thirty five feet, which I formally had my Chaise house erected therein, and now forming the Western boundary of my property which I purchased from Miss Fox aforesaid, to Umbelina the wife of my nephew Antonio Gomes deceased aforesaid.

I devise my freehold house and land number Thirty four High street aforesaid, situate immediately to the East of my house, and land devised to Umbelina the wife of Antonio Gomes aforesaid, which I purchased from Mrs Goodman to Virginia wife of Norris Mendes aforesaid.

I devise my freehold house and land number Thirty two High Street aforesaid situate immediately to the East of my house and land devised to Virginia wife of Norris Mendes to Joseph De Freitas aforesaid, son of my brother Antonio De Freitas deceased.

I devise my freehold house and land number Twenty two High Street aforesaid, facing the Defence Force Barracks, and which I purchased from John Halliday to Lily De Freitas daughter of my nephew Emanuel De Freitas deceased aforesaid

  • to Manuel De Freitas, son of my brother Antonio De Freitas deceased aforesaid at present residing in the United States of America the sum of Seven hundred dollars

  • to the lawful children of Mary Bento, late of the Island of Madeira daughter of my niece Jokina Fereira the sum of Two hundred dollars in equal shares

  • to my niece Jokina Fereira, of the Island of Madeira the sum of Six hundred dollars

  • to my niece Mary, wife of Manuel Francis of the Island of Madeira the sum of Five hundred dollars

  • to the lawful children of my said niece Mary, wife of Manuel Francis the sum of Six hundred dollars in equal shares

  • to Mary, wife of my brother Antonio De Freitas deceased aforesaid, of the Island of Madeira the sum of Four hundred dollars

  • to Mary Rose, sister of Umbelina wife of my nephew Antonio Gomes deceased aforesaid, of the Island of Madeira the sum of Two hundred and fifty dollars

  • to Alma wife of Charles Shoowl, the sum of one hundred dollars

  • to the lawful Children of Alma, wife of the said Charles Shoowl of the Island of Antigua the sum of one hundred dollars in equal shares

  • to the Priest in Charge of the Catholic Mission in Koral where I was born, in the Island of Madeira at the time of my death to be distributed to the poor of the said parish the sum of Two hundred and fifty dollars

  • to the Priest in Charge of the Catholic Mission at the Monte, in the Island of Madeira at the time of my death to be distributed to the poor of the said parish the sum of Two hundred and fifty dollars

  • to Joseph De Freitas, my Executor herein named to be distributed to the poor of the Island of Antigua the sum of one hundred dollars

  • to my nephew Joseph Gomes, son of Marcel Gomes at present residing in Koral, in the Island of Madeira the sum of Four hundred dollars

  • to Fanny Gomes, the daughter of my Uncle John De Freitas late of the City of Saint John deceased the sum of Seventy dollars

  • to Rosaline de Freitas, daughter of my Uncle John De Freitas deceased aforesaid the sum of one hundred dollars

  • to my Godson Martin Gonsalves, son of Antonio Gonsalves the sum of thirty dollars

  • to my niece Mary, wife of Manuel Ferara De Freitas of the Island of Madeira the sum of Two hundred dollars

  • to Josephine Gonsalves, of Millers Estate in the island of Antigua the sum of one hundred dollars

  • to Alice, wife of Warden Lahood Khoury of the island of Antigua the sum of Sixty dollars

  • to my Godson John Khoury, son of Alice, wife of Warden Lahood Khoury of the Island of Antigua the sum of Forty dollars

  • to Rose Gomes of the City of Saint John in the Island of Antigua the sum of one hundred dollars

  • to Mary, wife of Antonio Pereira deceased of the City of Saint John in the Island of Antigua the sum of one hundred dollars

  • to Virginia wife of Manuel De Silvia deceased the sum of sixty dollars

  • to my nephew Quino Fereira, brother of Manuel Fereira of the City of Saint John in the Island of Antigua, the sum of Three hundred dollars, and all the rest residual and remainder of my property, both real and personal, I give bequeath and devise to Ferdenand De Freitas, Virginia wife of Norris Mendes, and Lily De Freitas, children of my said nephew Emanuel De Freitas aforesaid, to Leonard De Freitas and Adelaide De Freitas, son and daughter of my nephew John De freitas, late of the City of Saint John aforesaid, to Lily daughter of my niece Mary Gonsalves aforesaid to Umbelina wife of my nephew Antonio Gomes aforesaid to Marcel Gomes son of my nephew Antonio Gomes in equal shares

  • In witness whereof I have set my hand to this will by making my mark to the same the Fourth day of May one thousand nine hundred and Twenty one.

Signed by the above named Fernando De Freitas, the testator as and for his last will and testament with his mark the same having been first read over and explained to him and he fully understanding the same in the presence of us both being present at the same time who in his presence and in the presence of each other have hereunto subscribed our names and witnesses

Fernando De Freitas was b
orn on 26th May 1849 and died sometime during July 1921

Following his death, Fernando's last Will and Testament was annexed in the Supreme Court of the Leeward Islands, Antigua Circuit, West Indies, on 27th July 1921
